Online Terms and Conditions
1.1 These general terms and conditions regulate aspects of the sale, namely registration and ordering, of products via the website with the following address: www.zilian.com.
1.2 For the purposes of these general terms and conditions, the following definitions shall apply:
- a) "Zilian", as Zilian Ibérica, Sociedade Unipessoal, Lda, with registered office at Av. António Augusto de Aguiar 29-D, 1050-251 Lisboa, with NIF 510589227, with share capital of € 1.187.000,00, holder of all copyright or related rights, as well as other rights that may be subject to protection under the Industrial Property Code on the page/website with the address zilian.com and supplier of the goods available to order on the same site;
- b) "Customer" means any natural person, other than a trader, who places an order through the page/website zilian.com.
1.3 These general terms and conditions do not affect the Customer's rights and guarantees set out in Decree-Law no. 24/2014 of February 14 and other legislation in force for contracts of this nature.
2. Registration
2.1 In order to place an order, it is not mandatory for the Customer to be registered on the website.
2.2 If, however, you wish to register, you can do so at the store by filling in a customer form, or via the website www.zilian.comby filling in the fields on the form available there.
2.3 After registering as a customer on the Zilian website, the customer can access their personal online account by logging in using the personal, non-transferable password they chose when registering.
2.4 Customers who have registered as a customer at a Zilian store can also access their personal online account by logging in using the password automatically created by the computer system and sent to their email inbox. The Customer can change this password on first access.
2.5. From the moment you access the www.zilian.com by logging in, the Customer is subject to these general conditions, as well as the legal and regulatory rules governing its operation and use.
3. Ordering
3.1. The order is placed by the Customer accessing the website www.zilian.comby logging in using their email address and password, if registered, and selecting the product or products available for sale online, concluding with confirmation of the delivery address and final validation of the order.
3.2 The Customer will receive, by email, all information relating to the following statuses of their order: order confirmation and confirmation of order processing and dispatch. The Customer will be able to follow the status of their order by accessing the "Orders and Returns" tab in their account, where they will be able to check the real-time status of their order.
3.3 In the event that your order is dispatched to your address or the address you have chosen, you will receive an email with the tracking number so that you can follow the delivery in real time via our shipping partner's platform. If the order is to be picked up in-store, an email will be sent to you when it is dispatched and you will be able to pick it up in-store within 1 to 3 working days. 3.4 During sales and/or promotions, there may be a delay in processing your order. You should therefore expect an additional 1-3 working days for your order to be dispatched.
3.5. The final validation of the order constitutes a declaration of full and unconditional acceptance by the Customer of the deal entered into, including acceptance of these general conditions, the legal and regulatory rules governing purchases of this nature, the price and characteristics of the product being ordered, with the consequent mutual enforceability of the services set out on the order form.
3.6. The products available to order can be found in the online store area on the website www.zilian.com.
3.7. Through Zilian Online you can also order your products for all European Community countries*. For other shipments, please contact us at zilian.online@zilian.com.
*Non-EU territoriesand countries outside the EU - We do not ship to these countries due to the possibility of customs duties being levied at the destination, amounts applied by local customs to the customer of which we have no indication.
3.7.1 We ship to certain countries outside the European Union, for which it is compulsory to provide a tax identification number. If the customer refuses to provide this information, the shipment will be made and the customer will be responsible for any additional costs that may arise at customs.
4. Delivery
4.1. Zilian will ship the product or products ordered by the Customer via the logistics operator to the address indicated by the Customer when confirming the order.
4.2. Deliveries will be made on the days and times used by the logistics operator.
4.3 If you have chosen home delivery, we will send you a shipping confirmation email (at the time of dispatch), another with a tracking number (with a link to the carrier's website) and, finally, the carrier will contact you by SMS message or email to inform you of the delivery of your order.
4.4 If you have opted for in-store delivery, we will notify you of the goods' arrival by SMS message, and you can pick them up at the store at any time. In-store pick-up can be done at ZiIian Lisboa - Av. António Augusto de Aguiar 29D and at Zilian Chiado - Rua Garret, 112 a 118, Lisboa.
4.5. Zilian will not deliver any product or products to PO boxes.
4.6. Zilian undertakes to fulfill the order within a maximum of 7 days from the date of payment.
4.7. Zilian will inform the Customer of the unavailability of the product or products ordered and will reimburse the amounts paid by the Customer for said product or products within a maximum period of 14 days from the date of knowledge of said unavailability.
5. Exchanges & Returns
5.1 In the Zilian online store, if you are not satisfied with your purchase, you may exchange or return the item(s) within 30 days of receiving the order.
5.2 Returns can be made in two ways: at a physical store (Zilian Av.ª Ant.º Augusto de Aguiar or Zilian Chiado), or by post. To return one or more items by post, you must send them to the following address: Av. António Augusto Aguiar 29D, 1050-251 Lisboa.
5.3 The item must be sent in its original box, together with a copy of the invoice.
5.4 The exchange or return request will only be valid once the return form has been duly completed. The box must be properly sealed so that no loss or other detrimental event occurs during shipment to Zilian's warehouse. The shipping costs of the item will be borne entirely by the Customer.
5.4 Upon confirmation by Zilian staff that the item has been returned in the condition in which it was delivered to the Customer, Zilian will initiate the refund of the price, by the same payment method used for the purchase. The refund will be made within a maximum of 14 working days, depending on the banks involved. If the order was paid for using an ATM reference, you must enter the IBAN on the form so that the price of the item(s) can be refunded by bank transfer. As soon as the refund operation has been completed, you will receive an email to this effect.
5.5 If you consider that the item you have received is not in normal or usual condition, in accordance with the terms agreed, you should contact customer service. You should send an email to zilian.online@zilian.com with an explanation of the situation, including photographs that make it possible to understand and assess the possible defect. Our team will then contact you as soon as possible.
5.6 If you do not receive your order, you should contact customer service at zilian.online@zilian.com or by calling +351 912 318 413 -Calling thenational mobile network.
5.7 If you cannot be at the place of delivery at the agreed time, please contact us so that we can arrange delivery for another day. Please note that if the product is not delivered within the stipulated time, you may be charged for the costs of storing the products and making new delivery attempts
6. Price and characteristics of the products
6.1 The price of the products for sale on the www.zilian.com website is identified there, in euros, including VAT (23%), taxes or other levies. The prices on the www.zilian.com may be modified at any time without prior notice.
6.2 The products offered by Zilian are presented on the website www.zilian.comand are accompanied by a description of their characteristics, so it is understood that the Customer was aware of them before placing the order.
6.3 Items sold on ARCHIVE SALE are out of stock and may therefore be subject to special conditions, without jeopardizing their proper state of use. These special conditions may include, but are not limited to, scratches on the sole, label marks and/or small scratches or stains on the leather. The way in which these special conditions are marked will be exclusively by means of the photograph(s) made available on the site. The same exchange/return policy will apply as for other items.
6.4 The price will be paid by the Customer by Credit Card, MBWay or PAYPAL.
6.5 The order will only be considered completed once payment has been made.
6.6 Use of the www.zilian.com does not entail any additional costs.
6.7 Without prejudice to the previous paragraph, the Customer shall bear the costs of delivering the order, known as shipping costs, which shall be communicated to and accepted by the Customer when the order is sent.
6.8. The maximum number of products per order is 10.
6.9. The Online Shop's shipping costs are charged according to the location of the destination. Orders under 130€ (one hundred and thirty euros) to Portugal cost 3.95€ (three euros and ninety-five cents). Orders over 130€ (one hundred and thirty euros) to mainland Portugal have free standard shipping.
6.10. If the Customer chooses the option of picking up the order in store, no shipping costs are due.

6.12. For shipments outside the list shown, request a quote via email to zilian.online@zilian.com.
6.13. Zis and Birthday vouchers cannot be applied to items with a promotional value, with the exception of the Birthday voucher during the Sale period.
7. Right of withdrawal
7.1. The Customer may terminate the contract, without any justification or payment of compensation, within 30 days of receiving the order.
7.2 In the event of withdrawal under the terms set out in the previous paragraph, the Customer must keep the good or goods in such a way as to be able to return them to Zilian in their original packaging and in perfect condition.
7.3 Zilian will reimburse the amounts paid for the products ordered, in the event of the Customer exercising the right of withdrawal, within 30 days from the date of receipt of the return, at no cost to the Customer, except for the costs of sending and returning the goods, which will not be reimbursed by Zilian. Refunds are processed by bank transfer for ATM payments, using the NIB indicated by the customer. In the case of payment by Credit Card/Paypal, the refund is processed by Credit Card/Paypal and no additional information is required from the customer.
7.4 In the case of orders paid for by credit, the credit agreement is automatically and simultaneously terminated, without the right to compensation.
7.5. The Customer may communicate their choice to exercise the right of withdrawal either via the email address zilian.online@zilian.com, or in writing sent by post to the address Av. António Augusto de Aguiar, 29D, 1050-251 Lisboa or delivered in person to a Zilian store.
7.6.1 The consumer has the right to freely withdraw from this contract within 30 calendar days, without having to give any reason. The period for exercising the right of withdrawal expires 30 days from the day following the day on which the order is confirmed.
7.6.2 In order to exercise their right of withdrawal, the Customer must communicate their decision to withdraw from this contract by means of an unequivocal statement (e.g. registered letter sent by post or email).
7.6.3 You can use the model withdrawal form available on the Zilian website (http://zilian.com/ajuda/pagamento-e-devolucoes), but this is not obligatory.
7.6.4 If the Customer makes use of this option, Zilian will send an acknowledgement of receipt of the withdrawal request on a durable medium (e.g. by email) without delay.
7.6.5 In order for the withdrawal period to be respected, it is sufficient that your communication regarding the exercise of the right of withdrawal is sent before the expiry of the withdrawal period.
7.6.6 In the event of termination of the contract, you will be refunded all payments made, including delivery costs (with the exception of additional costs resulting from your choice of a shipping method other than the least expensive standard shipping method offered by us), without undue delay and in any event no later than 14 days from the date on which Zilian is informed of your decision to terminate this contract.
7.6.7 Zilian makes refunds using the same means of payment as it used for the initial transaction, unless expressly agreed otherwise by you; in any event, it does not incur any costs as a result of such refund.
7.6.8. Zilian has the right to withhold the refund until receipt of the returned goods, or until the Customer provides proof of shipment of the goods, whichever occurs first.
8. Other guarantees
8.1. Any refund by Zilian of sums paid by the Customer shall be made taking into account the price actually paid by the Customer.
8.2 The costs of returning the order will be borne by the Customer.
8.3 The Customer may submit their complaints either via the e-mail address zilian.online@zilian.com, or in writing sent by post to the address Av. António Augusto de Aguiar 29-D, 1050-251 Lisboa or delivered in person to a Zilian store. Or via the Online Complaints Book
9. Liability
9.1 Zilian is not liable for any damage arising from abusive intervention by third parties in the computer system that supports the site or for damage arising from the use of the Internet and resulting from the presence of computer viruses or other malicious software on the site.
9.2 The exclusive purpose of the www.zilian.com website is to promote the Zilian brand and to make products supplied by Zilian available to the Customer, under the conditions indicated, and it may not be used for any other purpose.
9.3 Zilian shall not be liable for any misuse of the Customer's access data to the site, which is personal and non-transferable, by third parties.
10. Duration
10.1 These general terms and conditions apply for the duration of the supply of goods via www.zilian.com.
10.2 The provisions of the previous paragraph are without prejudice to the possibility of subsequent revision and/or amendment of these conditions.
10.3 The declaration of nullity of one or more of the general conditions does not exclude the application of the others or imply the invalidity of the business concluded, without prejudice to the provisions of article 294 of the Civil Code.
11. Proof and archiving
11.1 The computer records kept on Zilian 's computer systems are considered proof of the conclusion of the contract between the parties as well as the conditions under which it was concluded.
11.2 Proof of orders and associated invoices shall be stored on a reliable and durable medium.
13. Zilian Gift Card
13.1 The general conditions of use of the Gift Card can also be consulted in Zilian stores and by e-mailing info@zilian.com. The Zilian Gift Card is only valid on presentation of the respective receipt and is available in the amounts of 30€ / 50€ / 70€ which are valid for purchases of products sold in all Zilian stores and also at www.zilian.com.
13.2 To use the Gift Card in the online store, you must request the corresponding alphanumeric code via email to zilian.online@zilian.com and apply it when checking out your order.
13.3 The value of the gift card can be used one or more times, and cannot give rise to any monetary compensation, cash refund or return of change, until the balance has been used up and all values will be accumulated in the respective customer file.
13.4 The preservation of the physical card is the responsibility of the cardholder and Zilian will not be held liable in the event of loss or theft. In any case, you can contact Zilian at info@zilian.com.
13.5 Once the Gift Card has expired, it cannot be exchanged or sold.
13.6 This Gift Card is issued and distributed by the Zilian brand which belongs to Zilian Ibérica, Sociedade Unipessoal, Lda, with its registered office at Av. António Augusto de Aguiar 29-D, 1050-251 Lisboa.
13.7 The Zilian Gift Card is valid for 90 days from the date of issue.
